Legitimate Interest

Definition:

Legitimate Interest is a clear and specific benefit or outcome which is recognised as a lawful basis for the processing of personal data, subject to such processing being necessary to achieve the benefit or outcome and not being outweighed by detrimental impact to the fundamental rights of the Data Subject.

Commentary:

The notion of processing data based on legitimate interest can be manifested in different terms under data protection regulations. Some jurisdictions do not explicitly spell out the ground of processing data based on “legitimate interest” per se, but adopt alternative such as processing data on lawful basis, and other grounds to process personal data as derogations or exceptions.
